Record Bin Radio / Record Bin Social Club is a project of KMX Media LLC, a California limited liability corporation.
Privacy Commitment
KMX Media LLC is committed to protecting the privacy of its subscribers, artists, account holders, and website visitors. We collect only the information reasonably necessary to operate the platform, manage memberships and artist accounts, provide communications, and fulfill our legal and operational obligations.
Information We Collect
Depending on your use of the platform, we may collect:
- Name and email address.
- State of residence provided through account registration or platform records.
- Internet protocol (IP) address.
- Artist website URLs and social media profile links.
- Mobile telephone numbers, mailing addresses, dates of birth, and related onboarding information provided by artists.
- User-generated content, including profile information, posts, comments, images, audio, video, messages, and other content voluntarily submitted to the platform.
Subscription payment information is processed directly by Stripe and merchandise payments are processed through Printful. Record Bin Radio and KMX Media LLC do not receive, store, or have access to payment card numbers, banking credentials, or similar payment information.
How We Use Information
The information we collect is used solely to:
- Create and administer user accounts.
- Provide subscription services and membership benefits.
- Deliver newsletters, updates, and platform communications.
- Manage artist profiles, onboarding, and professional relationships.
- Facilitate payroll, employment, contractor administration, or similar services through authorized third-party providers.
- Operate, maintain, improve, and secure the platform.
- Comply with legal, regulatory, and contractual obligations.
We do not sell personal information and do not use personal information for third-party marketing, data brokerage activities, behavioral advertising, or unrelated commercial purposes.

California residents have rights under the California Consumer Privacy Act ("CCPA"), as amended, including the right to:

Authorized Agents
California residents may designate an authorized agent to submit privacy-related requests on their behalf. We may require documentation demonstrating the agent's authority and may verify the consumer's identity as permitted by law.

Under California Civil Code Section 1798.83, California residents may request information regarding disclosures of personal information to third parties for direct marketing purposes. KMX Media LLC does not disclose personal information to third parties for their direct marketing purposes.
User Accounts and User-Generated Content
KMX Media LLC may allow subscribers, artists, and other account holders to create profiles and post content, including text, images, audio recordings, videos, comments, messages, links, and promotional materials. Users remain solely responsible for all content they submit, post, upload, transmit, or otherwise make available through the platform. By posting content, you represent and warrant that:
- You own or control all rights necessary to post the content.
- The content does not infringe any copyright, trademark, publicity right, privacy right, or other legal right of any third party.
- The content complies with applicable federal, state, local, and international laws.
- The content is not unlawful, fraudulent, defamatory, threatening, misleading, harassing, or otherwise objectionable.
By submitting content, you grant KMX Media LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and otherwise use the content as necessary to operate, promote, and provide the platform and its services.
Right of Publicity and AI-Generated Content
Users may not upload, publish, distribute, or generate content that uses another person's name, image, likeness, voice, signature, identity, persona, or other indicia of identity without appropriate authorization. This restriction applies equally to synthetic, artificial intelligence-generated, manipulated, cloned, or simulated representations of individuals. KMX Media LLC reserves the right to remove any content that may violate privacy rights, publicity rights, intellectual property rights, or applicable law.
DMCA Copyright Policy
KMX Media LLC respects the intellectual property rights of others and expects users to do the same. If you believe content available through the platform infringes your copyright, you may submit a copyright infringement notice pursuant to the Digital Millennium Copyright Act ("DMCA") containing:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material and its location on the platform.
- Your contact information.
- A statement of good-faith belief that the disputed use is not authorized.

KMX Media LLC acts as a service provider and platform operator. We do not routinely review, verify, endorse, monitor, or guarantee the accuracy, legality, safety, quality, reliability, or authenticity of user-generated content. Opinions, statements, recommendations, and materials posted by users belong solely to those users and do not necessarily reflect the views of Record Bin Radio, Record Bin Social Club, or KMX Media LLC. We reserve the right, but assume no obligation, to review, restrict, remove, disable, or refuse content or accounts that violate platform policies, legal requirements, or the rights of others.
Third-Party Service Providers
Certain services are provided by independent third parties, including:
- Ghost.org for account and subscription management.
- Stripe for payment processing.
- Radio.co for radio broadcasting.
- Printful.com for merchandise sales and fulfillment.
- Professional Employer Organizations (PEOs) and related workforce-management providers for artist onboarding, payroll, benefits, tax administration, and related services.
Information processed by these providers is subject to their own privacy practices, security procedures, and terms of service. While we use reputable providers, we cannot guarantee the security or practices of third-party systems.
Embedded Content and External Services
The platform may contain embedded content from third-party websites and services, including videos, music players, social media feeds, articles, and similar materials. Embedded content operates as though you visited the third-party website directly. Those providers may collect information, use cookies, and monitor interactions according to their own privacy policies.
Limitation of Liability
To the fullest extent permitted by law, KMX Media LLC is not responsible for user-generated content, third-party content, actions of platform users, unauthorized access to user accounts, or acts or omissions of independent service providers. Users access and use the platform at their own risk.
Privacy Metrics
If required by applicable California law, KMX Media LLC will publish annual privacy rights metrics concerning consumer requests received and processed.

Counter Notifications

Record Bin Radio reserves the right to suspend or terminate accounts of users who repeatedly infringe intellectual property rights.

Record Bin Radio acts solely as an online service provider and does not pre-screen, edit, verify, endorse, or assume responsibility for user-submitted content. Users are solely responsible for the content they upload, publish, or distribute through the platform.
